A North Dakota man learned Monday that his charges were reduced from first-degree murder to manslaughter.

The Post Millennial reports that the man reportedly ran over a teen he deemed a “right-wing extremist.”.

Shannon Brandt, 42, was originally charged with a Class AA Felony murder charge. However, that has been lowered to a manslaughter charge in the death of 18-year-old Cayler Ellingson.

The Associated Press reports that Foster County State Attorney Kara Brinster chose to reduce the severity of the charge, NOT as part of a plea deal with the defendant. Brandt is expected to appear in court on May 30 to answer these charges.

Brandt’s lawyer Mark Friese said, “There is no evidence to support the misplaced allegation of intentional homicide,” and “The state and defense forensic experts have provided comprehensive reports confirming this tragedy was an accident. Misplaced media hype and community conjecture is no substitute for evidence.”

An autopsy conducted on the victim of this situation found that Ellingson’s injuries “weren’t caused from being struck by Shannon Brandt’s vehicle and were caused by being run over.”

After the incident, Brandt returned to the scene and called 911 on himself. However, according to the Post Millennial, he fled the scene before first responders could arrive. That meant he was also charged with “failing [ing] to render aid as required” under North Dakota law.

Police found Brandt shortly after the incident and reported that Brandt attempted to have consumed alcohol before the incident. They arrested him for driving under the influence at that time. A chemical test on him later confirmed that he was above the legal limit for alcohol in his system before the accident.

The Post Millennial reports that a murder charge could imprison Brandt for life. However, the reduced charge of manslaughter he is facing now comes with a maximum sentence of just ten years.
