The Senate Judiciary Committee sent another Biden nominee for the federal court forward despite that nominee being unable to answer basic constitutional questions.

Charnelle Bjelkengren, judge for the Spokane County Superior Court in the Eastern District of Washington, was nominated but could not recall the contents of Articles II and V when asked about them based on reporting by Conservative Daily News. Republican Louisiana Sen. John Kennedy asked her about these specific law provisions during her confirmation hearing in January.

Democratic California Sen. Dianne Feinstein had been out of the Senate with a case of shingles for several weeks. This prevented the committee from moving forward on this nominee as it was deadlocked with 6 Democrats and 6 Republicans without her. However, Senator Feinstein has made a dramatic comeback to the Senate and cast her vote to move forward with this nominee.

Five other nominations held up because of Feinstein’s illness have now advanced to the full Senate. Bjelkengren, Colorado District judge nominee S. Kato Crews, and Southern District of California judge nominee Marian Gaston were all advanced without a single Republican vote in favor of them. That is just how divided things are in the Senate right now.

Crews was asked by Representative Kennedy what a Brady motion was and could not answer that question adequately. Crews was also pressed on previous writings about eliminating laws banning sex offenders from living near schools. However, it seems that Crews wanted to skate away from challenging questions like this.

“[Bjelkengren] may well have the title of the least qualified nominee I’ve seen in eleven years serving on this committee,” said Republican Senator Ted Cruz during the hearing. He continued by saying: “This is not some obscure question about some obscure Latin phrase no one should know,” and “This is literally the basic architecture of our constitution.”

Northern District of Illinois nominee Jeremy Daniel, District of Maryland nominee Brendan Hurson and Eastern District of Louisiana nominee Darrel Papillion were other nominees who advanced on Thursday. These are the kind of people the Democrats are happy to push forward because they believe it will result in more of their agenda moving forward in the courts.

Many of these nominees have a checkered history of some kind or question marks on their records. Regardless, Democrats continue to push them forward without considering that they can only do so because a sickly 89-year-old Senator has been wheeled in to help pass these votes.
